This decision gives me great hope fot the future of the court. Sodomy laws have been one of those issues the court has been reluctant to overturn, even despite the great strides the court has made in the area of privacy. This tells me that Bush cannot disrupt the balance of the court. His best bet would be to replace Renhquist with another like him, but obviously, Renhquist must retire in order for him to do that. This also tells me how unlikely it is that the court will ever overrule >Roe, assuming they even grant certiorari. Homos everywhere, go out with your gay self, show some pride and dance in the streets. No longer do you have to worry about antiquated, bigoted laws making your sexual lives public information. This is a HUGE step in the right direction. HUGE. BIG. HUGE. This opens to door to gays being treated with some legitimacy and respect. This tells us that religious morality will not be the basis upon which the rest of the country must live. Some of the more ardent Conservative, Scalia and the defense among them, have argued that this ruling invalidates many similar laws, such as laws against masturbation, beastality, inscent, adultery, and prostitution. Well, to that I say, it does to an extent. It opens to door to strike down laws that discriminate against the private behavior of two CONSENTING ADULTS. Let me repeat: TWO CONSENTING ADULTS. Addressing adultery - that is not against the law. Religiously and morally, it may not be right to commit yourself ot one person only to cheat, but it is not a crime, so let's nix that one straight away. Beastiality and inscent, however, do NOT deal with two consenting adults. They deal with one adult imposing their will upon someone or something without the capacity to consent. This ruling has no bearing on those issues. As for masturbation and prostitution. Masturbation? Are we seriously going to call that a crime? No wonder Scalia is so damned repressed. He never gets his rocks off. He probably has a very small penis. Prostitution, in my honest opinion, should not be illegal. Aside from how much the state could tax the hell out of it, we are talking about one of the oldest professions here. If it has not gone away yet, it never will. Why not make the enterprise safe for all participants? Why not get people off the streets? Why not legalize it and mandate certain health codes that must be upheld when running a brothel? Then tax the hell out of it as they do with any legal form of entertainment, like cigarettes and alcohol. In any event, I linked to the case above. I may have more to say on this later, but everyone knows I am a fag hag, so it should come as no surprise that I am in love with this ruling right now. Justice Kennedy should have my love child. It distresses me, however, that so many people are fighting so hard against this ruling. I am not surprised, but I glanced at the AOHell message board on the subject and it really bothered me.
